The residence permit (permesso di soggiorno) is the document that allows a foreign national to stay lawfully in Italy. It is issued for a specific purpose — work, family, study, protection, medical treatment, pending employment — and each purpose has its own requirements, duration and renewal rules.
The firm assists those who need to file an application, those who need to renew an expiring permit, those who wish to convert it to a different purpose, and those who have received a refusal.
The situations that arise most often
- First issue after entry with a visa, or in the cases provided by law for those already present in Italy.
- Renewal of an expiring permit, verifying that the required conditions are still met at the time of the application.
- Conversion from one purpose to another: the most frequent is conversion to work, where the conditions are met.
- EU long-term residence permit, for those who have completed the required period of residence.
- Refusal or revocation: examination of the measure received, verification of the time limits and assessment of the grounds for challenging it.
When it is advisable to consult a lawyer
Not every application requires legal assistance: many are filed at the counter or through a patronato. The advice of a lawyer is appropriate, however, when:
- a refusal decision or a notice of intended rejection has arrived;
- the employment or family situation has changed since the permit was issued;
- there are criminal records, even old ones, that may affect the assessment;
- the application has been pending for a long time without a reply;
- a decision must be made on converting the permit and it is unclear which route is available.
Time limits matter more than anything else
Against a negative decision the law allows a period in which to lodge a challenge, running from the date of service. This is the single most important piece of information: keep the envelope or the communication showing the date and seek advice promptly, because once the time limit has expired that route is closed.
What to prepare
- passport or identity document;
- the residence permit, even if expired, and the receipt of any renewal application;
- any decisions already received, with the date of service;
- documents relating to work (contract, payslips) or to the family, if the matter concerns them;
- correspondence with the Questura or the Prefettura, if there has been any.
Photographs taken with a phone are fine for a first review, provided the whole document is legible.
How the consultation works
The initial review of the situation, the reading of the documents and the indication of the steps to take can also be carried out remotely, and you may write to the firm in your own language. A meeting in person is necessary, instead, when a power of attorney has to be signed or original documents have to be examined.
