On Juvenile Court of Palermo by decree dated 28.04.2020 authorized a foreign citizen, father of three minor children residing in Italy, to stay in the national territory with a two-year residence permit.
The Court, having regard to articles 31 paragraph 3 of Legislative Decree 286/98 and articles 333 c.p.c. and 741 paragraph 2 c.p.c., recognized that the family unit was well integrated into its social context and that, therefore, the removal of the parent would constitute grounds for serious harm to the minors, in contrast with the Convention on the Rights of the Child of November 20, 1989, as well as with the right that every child has to grow up within their own family.
